I give you my child

Her hair is long, fiery red and curly, just as unmanageable as mine. She sits in front of me at the office, and tries to get the words that come out of her mouth to sound coherent, but her uninterrupted sobbing makes for a difficult conversation. Her 19 year old son sits next to her, addled between looking like a wanna-be bad-ass gang member and a scaredy cat looking at a 15-year prison term with a 7 year prison offer on the table.

We talk about the case, the evidence, the gang evidence, the gun used, the forensic evidence, ballistics, Gun Shot Residue, the "admission" signed by the client, the video showing the shooting, the field identification cards... We talk about his age, his lack of prior brush with law enforcement, his immigrant family and working parents. His successful siblings... and the path that this young punk has chosen.

"It's very simple", i say to this 19 year old whose innocent childish eyes betray the menacing facial hair covering his face. "i am not your mother. i don't have time for your excuses, or bullshit. Don't waste my time if you're not gonna listen to me. But if you want me to represent you, you gonna have to man up and do as i say. If you don't, i'll break your knee caps and will make you cry. This is the day you decide whether you gonna clean up your shit and say goodbye to the gangs, drugs and your street life or you gonna end up living in the shadows as a gang member. Which one is it??"

Before he has the time to answer, mom says: "I give you my son... please do what you can".

Nine months of fighting in Court, 9 months of motions, conferences and setting up a defense. 9 months of fighting the DA, and the best that we have on the table is a 3 year state prison offer.

In the meanwhile, he has enrolled and continuing with his college education. He has a full time job, and has moved to a better neighborhood outside of gang territory and lives with his girlfriend. He is dressed up in slacks and a sweater, and is clean shaven.

We can't take the offer. Prison will make him a full fledged gang member. I can't go to trial either. I will lose as i have no defense. I ask for a chamber conference with the Judge, and try to explain to the Court why he should be given a chance at probation so that he can eventually reduce his felonies and strikes and clean his record. I explain his immigrant parents. I explain the 19 year old's life. and i find myself welling up and becoming emotional.


"Your honor, i have a 19 year old" i say... "but for the grace of God, it could have been my child. Give him the chance to prove himself and yet the rope to hang himself. Give him the choice to redeem himself. I will stand by him and my office will provide him will all sorts of support services. Give him a probationary sentence. I will deliver a respectful member of the community to you".

My client pled open to the charges today. He faces a maximum of 15 years if he violates. But if he does well for the next 5 years, the court will reduce his felonies to misdemeanors, his strikes will fall by the wayside, and he'll be able to clean up his record.

He won't do any jail time. He won't do prison time. He will remain in school and finish his education and will become a fully integrated member of the community.

As we walk out of court, mom and dad and my client hug me and sob. I look at him and say: "Don't disappoint me" and i walk away unable to hold back my tears. My thoughts are with my own teen age sons. I thank you boys for teaching me love and patience, for making me understand life and teaching me the power of communication and forgiveness. I thank you for showing me the challenges of your generation and the avenues to deal with it. And most importantly, i thank you for making me a better mother so that i can be a better advocate for my clients...

And to you mothers out there who have trusted me with your teenagers. Thank you for sharing your kids with me and allowing me the opportunity to be a part of their wondrous life. I have hundreds of children out there, who have risen up to the challenge, and made exceptional members of the society from the wreckage of their arrests. Thank you for making my job an incredibly rewarding career....

The Sun Shines at UCLA Career Center

Alaleh?  are you available to sit on a panel at UCLA about careers in law? said the message in my Facebook inbox? Sanaz Nabati Career counselor at UCLA was contacting me to invite me to sit on a Panel at UCLA Career Center to discuss Law with prospective law students....

I was sitting in Court waiting for the Judge on a really messed up Murder case. And this message was like a piece of candy after a hard night of drinking... soothing for the soul and invigorating for the body.. I chuckled to myself. Have i ever met a microphone that i didn't like, i asked myself?? Of course i will talk to these students...

So, i show up, to look at a room full of UCLA students, shy, excited, ambitious, apprehensive and thirsty.... thirsty for knowledge, thirsty for answers. And i think to myself, OH MY GOD. they are so young!!!! Was i this young when i was in College? did i look this innocent? did i have this look of awe and thirst on my face when i was their age???

And as i canvass this room, i see this beautiful face sitting in the front row. She smiled like she had swallowed the sun. And, i know. i just know that i have seen this smile somewhere before.

We do what we are supposed to do... As a panel we discuss, we present and and we impart our vast knowledge of the law with these bright-eyed bushy-tailed young students. Sunshine sits in front of me, and every time i glance at her, she is looking at me, with her gorgeous smile... and drinking up the information, as if drinking from the fountain of youth.

The night winds itself down...and I'm surrounded by a half dozens students. They're asking questions.. they are each patiently waiting their turn, to tell their story, to ask their questions and ask if the law is for them.... And i look up and see Sunshine waiting patiently.

Finally, I make my way to Sunshine. And i say: "I know you. Where do i know you from?" And she responds: I saw you several years ago, at Nessah Temple. You were speaking about Juvenile crimes at Nessah Israel with Dr. Orly Saghian, Ph.D. And I didn't know if I wanted to go to Medical School or Law school. And that day, after you spoke to us, i made up my mind that i wanted to become an attorney. You inspired me to become an Attorney"

Do you know what it feels like to be washed over with emotions so strong that you feel like your knees are about to buckle? Do you know what it feels like when you are hit inside the pit of your stomach with the realization that you can make a difference in other people's lives without ever knowing or having intended to??

I well up in tears. And all I can think is Oh, My, God! ... I am the luckiest woman on earth. I do what I love, I get paid for I love, and I inspire young women to follow my path. ... Can I get any luckier than this? can I be blessed any more?

I hug her. i am at a loss of words. Sunshine is truly sunshine. She radiates warmth and along with her warmth, she brings happiness.

You know who you are. Thank you for being you, for being there at Nessah, for being here tonight and for talking to me tonight. Wherever you go, may the road rise to greet you. May the Sun be behind you shining on you. And may you navigate life's vicissitudes with ease and wisdom.

Thank you for the gift you gave me tonight. I love you.

Destruction of Enemies is a good thing.

They never found the body... but the forensic evidence and the suspect's statements led the LAPD to believe that he had shot his brother and disposed of the body.

The cadaver dogs had positively reacted to the backyard... There were purchases made from Home Depot for all sorts of tools, including a shovel, an axe, 30 pounds of briquets, and a hammer.

The bottom lining of the living room couch was missing, there were human hair stuck in the nails at the bottom.

We stood in court, face to face, the prosecutor and I... she had charged my client with 1st degree murder, seeking a life sentence. The detectives standing behind her, holding the 2 volume murder book, spanning the 1.5 year murder investigation, looked at me with a poker face, trying to gauge my ability and fortitude...

....

In the process of defending the case, and defending my client's life, in the process of finding justice between a Murder and a Manslaughter, in the process of matching the facts and deleting the suppositions, the prosecutor and i tested each other's mettle. I took her to task. I challenged her theories, her suppositions, and she returned the favor.
.....

A few short years have passed since then. And Madame prosecutor, who took me to task, and whom i fought hard and long in that battle is now a Judge. I walked into her Court today... She saw me, she lit up, and she smiled. Her eyes sparkled. She got off the bench, hugged me and i hugged her back.

I am reminded of Abraham Lincoln's quote: Am I not destroying my enemies when I make friends of them?"

Someday, before i am old and grey, before i have lost my wits to senility, i will write about this one case that cored my soul, hollowed me of breath, and hallowed my practice. But until that day comes, ... i am the luckiest girl who practices what she loves and her passion for her work has translated into a tale of 1001 stories that would put Sheherzad to shame.

Release...


The greatest harm that takes place in our justice system, is not because the cops or the prosecutors are crooked or mean or have a hidden agenda.  It is because they are overworked, underpaid, over stressed and under funded...

So, naturally... details are lost... and sometimes, a man's innocence which could have been vindicated with only a small detail, a small bit of evidence, a tiny shred of the immutable truth gets buried and entombed... victim to sloth, to apathy, to languid indifference...

And i sit in my office, burning the candle..., knowing that the truth, like a naked child hiding from the public, is there... somewhere on my desk, in my binders, in my reports, in my research... I have it all in my head, 'cause I've analyzed it in my  head countless times as i've been prepping for the big day...

The adrenaline kick is strong.  It is an amazing sustained rush which keeps me going for hours.  Sleep means nothing. Hunger dissipates... My heart's elevated and rhythmic thumping synchronizes itself with the trance music playing in the background of the office...

And as I prepare my questions, my cross examination, the identification of the documentation;  slowly, the palms of my hands slowly sweat... my breathing has become shallow...my throat is drying up...

 It's mounting, ... the force, the tension, the pressure... waiting for that one question, that one piece of evidence, and that one ruling... I can see it, i can taste it.. i want it .. i want to consume my release, to earn my victory, to make my mark, to achieve my vision, and to vindicate my client...

and yet i know, ... like all fantasies, it can be so beautiful and well planned in the head, and yet when it comes to execution, reality has a nasty way of interfering with life.

Until yet another victory.
